Leaving NY with my child...can i?

The baby is not born yet..Then you can leave and what ever state you are living in when the baby is born then your ex would have to go there to fight for custody.But there is nothing he can do if the baby is not even born yet, it would not be kidnapping if there is no baby to kidnap..If the baby was born then it would be a different story.
